Welcome to My Health Docs. By accessing or using our platform at myhealthdocs.app, you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree, please do not use the Service.
1. About the Service
My Health Docs is a personal medical document storage and organisation platform operated as a sole proprietorship registered in Mumbai, Maharashtra, India. It allows individuals to upload and store medical reports (PDF format only), organise them by family member, report type, and date, and search and retrieve documents conveniently.
2. Eligibility
The Service is available to users of all ages. There is no minimum age requirement to create an account.
If you are a parent or legal guardian, you may add and manage medical records on behalf of minor family members under your care. By doing so, you confirm that you are authorised to manage such data on their behalf.
Users from India and the United Arab Emirates (UAE) are specifically supported. Users from other jurisdictions may access the Service but should be aware these Terms are governed by Indian law.
3. Pricing & Subscriptions
My Health Docs is currently offered as a free service. You can upload, organise, and retrieve your medical documents at no cost during this phase.
When paid plans become available, the following terms will apply:
- Billing: Subscription fees will be billed in advance on a monthly or annual basis, as selected by you at the time of purchase. All prices will be displayed clearly before you confirm any payment.
- Payment Processing: Payments will be processed by a trusted third-party payment gateway (e.g., Razorpay or Stripe). We do not store your card or banking details on our servers.
- Taxes: Prices displayed may be exclusive of applicable taxes (e.g., GST for Indian users). The final amount inclusive of taxes will be shown before payment confirmation.
- Refunds: If you are dissatisfied with a paid plan, you may request a refund within 7 days of the billing date by contacting us at luckyinfosystems@gmail.com. Refunds are evaluated on a case-by-case basis and are not guaranteed after the 7-day window.
- Cancellation: You may cancel your paid subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the period ends, after which your account will revert to the free tier (if available) or be deactivated.
- Price Changes: We reserve the right to change subscription pricing. Any price changes will be communicated at least 30 days in advance via email.
4. Account Registration
You must register for an account to use the Service. You agree to provide accurate, complete, and current information during registration.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Notify us immediately at luckyinfosystems@gmail.com if you suspect any unauthorised use of your account. We reserve the right to suspend or terminate accounts that have been compromised or misused.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:
- Upload content that is not medical in nature (e.g., illegal content or copyrighted materials unrelated to health records).
- Impersonate another person or entity.
- Attempt to gain unauthorised access to other users' data or our systems.
- Reverse-engineer, decompile, or tamper with any part of the Service.
- Use the Service for commercial resale or redistribution without our prior written consent.
We reserve the right to suspend or permanently terminate any account found to be in violation of these standards, without prior notice.
6. Your Data & Ownership
You own your data. All medical reports and personal information you upload remain your exclusive property at all times. We claim no ownership over your uploaded content.
By uploading content, you grant us a limited, non-exclusive licence to store, process, and display your data solely for the purpose of providing the Service to you.
We will never sell, rent, share, or disclose your personal data or medical records to third parties — including insurers, hospitals, advertisers, or any other commercial entities — except as required by law.
7. Data Privacy & Security
All uploaded files are stored in private, access-controlled cloud storage hosted in India. Files are not publicly accessible and do not have public URLs. Each user's data is logically isolated from other users.
We comply with applicable Indian data protection laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 (DPDP Act). Our full Privacy Policy forms part of these Terms.
8. AI & Third-Party Processing (Future Feature)
Currently, uploaded documents are not processed by any AI, OCR, or third-party tool.
In the future, we may introduce optional AI-powered features such as text extraction or auto-tagging. Before any such feature is activated on your account, you will be informed clearly, your explicit consent will be obtained, and these Terms will be updated to reflect any associated third-party processing.
9. Medical Disclaimer
Always seek the advice of a qualified medical professional for any health-related concerns. In case of a medical emergency, contact emergency services immediately.
10. Data Retention & Account Deletion
You may delete your account at any time from within the application settings.
Upon account deletion, your data will be retained for a period of 90 days (3 months) to allow for account recovery in case of accidental deletion and to comply with applicable legal obligations.
After the 90-day retention period, all your data — including uploaded medical reports and personal information — will be permanently and irreversibly deleted from our systems. Please export or download any data you need before deleting your account.
11. Service Availability & Modifications
We strive to maintain a reliable Service; however, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable efforts to notify users of significant changes.
12. Intellectual Property
All intellectual property rights in the Service — including software, design, logo, brand name ("My Health Docs"), and underlying technology — are owned by or licensed to us. You may not copy, reproduce, or create derivative works without express written permission.
13. Limitation of Liability
To the fullest extent permitted by applicable law, My Health Docs and its proprietor shall not be liable for any indirect, incidental, special, or consequential damages, including:
- Loss of data due to user error or force majeure.
- Medical decisions made based on documents stored within the Service.
- Unauthorised access resulting from user negligence (e.g., sharing login credentials).
Our total liability in any matter arising from these Terms shall not exceed the amount paid by you to us in the 12 months preceding the claim. For users on the free tier, this amount is nil. For paid subscribers, liability shall not exceed the subscription fees paid in the 12 months prior to the claim.
14. Indemnification
You agree to indemnify and hold harmless My Health Docs, its proprietor, employees, and agents from any claims, damages, liabilities, and expenses arising out of your violation of these Terms, your misuse of the Service, or any content you upload that infringes upon the rights of a third party.
15. Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you via email or a prominent in-app notice. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of India, including:
- The Information Technology Act, 2000
- The Digital Personal Data Protection Act, 2023
- The Indian Contract Act, 1872
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India. We encourage users to contact us first at luckyinfosystems@gmail.com to resolve disputes amicably before initiating legal proceedings.
